Dividing Family Property in Alberta: Where the Law Starts
Alberta's Family Property Act applies to married spouses and to adult interdependent partners. Its starting point is that property acquired during the relationship is divided equally.
Some property is treated differently — for example, property owned before the relationship, inheritances, and certain gifts may be exempt in whole or in part, though growth in their value may still be shareable.
Identifying, valuing, and classifying property correctly is where most of the work happens, and where good records make a real difference.
