What Spousal Support Considers
Spousal support depends on the facts. Relevant issues may include the length of the relationship, roles during the relationship, income difference, childcare responsibilities, economic disadvantage, career sacrifices, financial need, and the ability to pay.
Spousal support is not automatic in every case. It also cannot be assessed properly without disclosure.
Advisory Guideline Ranges
The Spousal Support Advisory Guidelines are often used by lawyers and courts as a tool to consider possible support ranges. They are not the same as the child support tables, and they do not replace legal analysis. They help frame amount and duration once entitlement and income are assessed.
Negotiating Support
Support may be resolved through negotiation, mediation, collaborative divorce, a separation agreement, or court order. In some cases, a lump-sum payment may be considered. In others, monthly support, review terms, or time limits may be more appropriate.
